Burrells Wharf Estate Regulations

General

Burrells Wharf Freeholds have appointed Rendall & Rittner Ltd as Managing Agents and in that capacity Rendall & Rittner are responsible for the day to day running of the estate, including:

  • the cleaning of common parts;
  • maintenance of mechanical and electrical plant;
  • maintaining the structure of the buildings;
  • organisation & supervision of estate staff;
  • maintenance of the leisure centre

Estate Office

Burrells Wharf has 24 hour staffing supervised by the Estate Manager, Tom Quinlivan  and Deputy Manager, Paul Eva. The staff are based in the Estate Office located between Beacon House and Corsair House (see plan).

Estate staff duties include:

  • maintaining security on-site (CCTV cameras & entry card systems are linked back to the office);
  • dealing with enquiries from residents & visitors;
  • generally assisting in the day to day running of the estate.

Residents can arrange with the Estate Office for deliveries to be made direct to their flat, or for contractors to be given access in their absence. The office will hold keys and release them only with specific written instructions to do so. Please note that staff are unable to attend resident's property with contractors, and that keys are held without liability on the part of the Staff, Managing Agents or the Freeholder (BWFL).

Service Charge

The expenses incurred in providing these services are charged back to residents through the service charge. Rendall & Rittner Ltd are responsible for:

  • collecting Ground Rents and the Service Charge;
  • making payments on behalf of BWFL for goods & services;
  • keeping the accounts and arranging for their yearly audit

An estimate of the likely running costs of the estate is drawn up prior to the start of each new financial year (which starts 1st January), which is discussed and agreed with the Directors of BWFL.

When the estimate has been agreed it will form the basis of the service charge to be collected & is demanded half yearly just before the 1st January & 1st July. In compliance with the terms of the lease a service charge estimate is prepared for each building, which also provides for contributions to a reserve fund. A separate estimate is prepared for the estate costs to which all blocks contribute (includes staff costs, leisure centre facilities & all external common areas).

At the end of each financial year, independent auditors prepare audited accounts to show the actual expenditure that has been incurred throughout the financial year.

Rendall & Rittner are bound by the Landlord & Tenant Legislation, as are all managing agents, and have a duty to ensure:

  1. That all expenditure is reasonable
  2. That all invoices paid are available for any lessee to view (by appointment)

Alterations

If you wish to carry out alterations to your flat you should first obtain consent from BWFL (the Freeholder). This is in addition to other consents from Tower Hamlets Building Control officer and Planning dept. If the building is listed, consent will be required from English Heritage.

If you proceed with works without obtaining consent the Freeholder and Building Control officer or English Heritage can insist that the property is returned to it's original condition.

The principle areas for which a License for Alteration will be required will normally relate to work of a structural nature, some examples of which are listed below. If you are unsure whether you need to apply for a license please consult Duncan Rendall at Rendall & Rittner Ltd on 020 7702 0701.

  1. Renewal of front door which is of a different design & colour than was existing;
  2. Renewal of any windows;
  3. Installation of exposed timber floors, other than those installed by the developer as a design feature, or any alterations to floor coverings apart from lino & carpet renewal;
  4. The removal or alteration of internal walls or ceilings;
  5. Installation or relocation of additional bathrooms, shower rooms, radiators and kitchens;
  6. The installation of a satellite dish is not permitted.

Bicycles

It is not permitted for bicycles to be left in corridors, entrances or chained in the underground car parks. Secure bicycle cages are available for rent in the Wheel House and Brunel car parks. Cycles are stored here without liability on the Staff, Managing Agents or BWFL.

Car Parking & Wheel Clamping

Residents only have the facility to park one vehicle on site in their allocated bay (please refer to your lease for details), for which the Estate Office will provide a circular identification permit which must be displayed to avoid wheel clamping. Please ensure that you affix your permit to your windscreen adjacent to the tax disc, and that you always park in your allocated bay. Should a vehicle be parked in your bay without authority please advise the Estate Office so that it can be clamped, in which case you will be issued with a visitors permit until the offending vehicle is removed.

If residents have more than once vehicle they should rent a bay privately, or park off the estate.

The main square is reserved for visitors only and your circular windscreen permit is not valid for this area. Should you need to stop there for a period of up to five minutes (for loading and unloading) ensure that your hazard lights are on.

Please ensure that any visitors always obtain a visitors parking permit from the Estate Office before leaving their car and that their car is parked in a visitors bay.

An outside company is dealing with clamping on a random visit basis. It is therefore important that you ensure your car is correctly parked with the appropriate permit on display. The Estate staff cannot be held responsible if residents or visitors do not show the correct permit and are clamped. Estate Staff have no discretion or authority to arrange the removal of clamps.

Estate Agents Boards

It is not permitted for Estate Agent boards to be placed in the windows of flats or on exterior wall and balconies.

Function Room

The function room can be hired for private use via the Estate Office for £5 per hour, subject to a maximum of £20 per day. For commercial ventures the fee will be £100. The playing of loud music is prohibited and the room must be vacated by 11pm. Any damage incurred will be charged to the hirer or, in the case of a sublet flat where the tenant refuses to pay, the cost will be borne by the flat owner.

Heating

Heat to certain areas is provided through the estate system and the cost of this is incorporated in the service charge. Any defects with the system should be reported to the Estate Office who will instigate repairs. Normally costs are covered through the service charge.

Insurance Cover

Although common parts are insured through the service charge, it is essential that you take out personal contents cover and third party liability insurance in respect of your flat, or other flats, through accidental flood or fire etc. This is especially important for leaseholders of flats that are let.

Laundry & Dry Cleaning

The hanging of laundry on balconies and in corridors is strictly prohibited.

Items for dry cleaning may be left at the Estate Office from where they will be collected by a dry cleaning company and returned to the Estate Office, normally within 48 hours. The invoice will be attached to the garments when they are returned and the garments are then released upon payment being made at the Estate Office. Payment may be made by cheque or cash. Any items left at the Estate Office will be held without liability on the part of the Estate Staff, Managing Agents or Freeholder.

Leisure Centre

The leisure centre facilities are provided for the private use of residents and up to 2 accompanied guests only. No unaccompanied visitors will be permitted access.

The leisure centre is open between 7am and 11pm seven days a week. Cleaning will take place between 9 a.m. and 11 a.m. during which the changing areas will be closed for a short period. Please look out for any closure notices and cooperate with the cleaners so that they can complete the jobs quickly. The centre will close between 9am and 12pm one day a month for deep cleaning with chemicals. The leisure centre is unsupervised and all residents are responsible for their own safety. Regulations for the use of the leisure facilities are displayed in the entrance and all residents must ensure that they adhere to these.

Noise

Have consideration for your neighbours and do not disturb them. Please remember that the playing of loud music is strictly prohibited.

Pets

Under the terms of the lease, you are obliged to apply in writing for a license to keep pets. Provided your pet is not likely to cause a nuisance to other residents, such a license will not be unreasonably withheld. If you are keeping a pet but have not made an application, please notify the Estate Office immediately.

If you have a pet please ensure the animal does not foul the estate.

Post

Royal Mail is delivered either to each property or to the post rooms provided. If you are unsure of your correct postal address, please contact the Estate Office.

Small parcels may be delivered to the Estate Office but no responsibility will be accepted by the estate for any loss or damage. Large parcels cannot be accepted, but flat keys can be held and issued on specific written instruction (refer to "Estate Office" section). Mail not collected within once month will be returned to sender.

Refuse

Depending on the block in which you live, the method for disposing of your household refuse will vary. You should therefore contact the Estate Office if you are in any doubt about how to do this.

All residents should ensure that their rubbish is properly secured in an appropriate sealed bag and that no wet substances or bags of rubbish are left in the common parts.

Please refer to the the estate plan for the locations of the refuse rooms. Recycling bins are provided in the car park under Taffrail House.

Satellite Dishes

The erection of satellite dishes is strictly prohibited. There are communal satellite dishes which all lessees have the opportunity to link into.

Illegal dishes will be removed at the expense of the leaseholder concerned, who will also bear the cost of any necessary legal action.

Subletting

A formal license for subletting must be agreed with the Managing Agent before each letting takes place. Failure to do so leaves you in breach of covenant under the terms & conditions of your lease and legal action could be taken against you for forfeiture of your lease. The following points should therefore be taken into consideration:

  1. You are responsible for ensuring that your tenant abides by the covenants of your lease and the license for subletting;
  2. You remain responsible for full settlement of all ground rent and service charge by the due dates specified;
  3. You are obliged to provide the Estate Office with a UK address at which you can be contacted for service of notice, or the name and address of a UK agent who is authorised to act on your behalf;
  4. A copy of the proposed tenancy agreement is required together with details and references for the sub-tenants;
    A fee is charged for the preparation of the license in the sum of £50;
  5. You may wish to leave a set of keys with the Estate Office in case of emergency however, the site staff, managing agent or Freeholder cannot accept liability in this regard.

Barbeques

Barbeques are permitted in the main square and indeed are part of life at Burrells Wharf.

When using your BBQ we ask you to:

  • be considerate of other residents in Burrells Wharf who may not want to join your party
  • complete your party and tidy up by 11:00 p.m.
  • damp down your BBQ and let it cool overnight
  • Do not put hot ashes in to the bins - sounds obvious but people still do it.
  • The following day remove your BBQ stove from the square. An area under Taffrail House is reserved for this.
  • Stoves not removed from the square within 48 hours will be removed by Estate Staff and placed in the area under Taffrail House.
  • Please act sensibly; the main square is a great place for a BBQ on a warm summers evening or weekend. Please make sure its enjoyable for everybody

Barbeques are not permitted on any balconies of appartments as they constitute a fire risk. Should you be asked to remove and extinguish them by Estate Staff you must do so immediately.
